National Witch Hazel Day Sweepstakes

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
OVERVIEW: The National Witch Hazel Day Sweepstakes (the “Sweepstakes”) comprises three (3) separate Grand Prize drawings (one of each for the Dickinson’s, T.N. Dickinson’s, and Humphreys brands (“Brands”)) and one drawing for five (5) Runner-Up Prize winners. Entry into each Brand’s Grand Prize drawing is separate. Entries not selected for a Grand Prize are automatically eligible for the Runner-Up Prize drawing. Maximum one prize per person.
ELIGIBILITY: The Sweepstakes is open to legal residents of the United States who are 18 of age or older. Employees, officers, or directors of Dickinson Brands Inc. (“Sponsor”), or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Sweepstakes (collectively, the “Sweepstakes Entities”), as well as the immediate family and household members of each such person, are not eligible to participate.
SWEEPSTAKES PERIOD: The Sweepstakes begins on 10/11/22 at 12:00:01 a.m. Eastern Time (“ET”), and ends on 10/20/22 at 11:59:59 p.m. ET (the “Sweepstakes Period”).
HOW TO ENTER: During the Sweepstakes Period, log in to Instagram and post an original photo or video of yourself sharing why you love one or more products from one of the following brands: Dickinson’s, T.N. Dickinson’s, or Humphreys (“Post”). Instagram accounts are free. Your Post must include the hashtag #NWHDSweepstakes and tag the Brand you are posting about: @dickinsonswitchhazel, @tndickinsons, or @humphreyswitchhazel. Only Posts with both the hashtag and Brand account tag can be counted as entries. Your Instagram account must be set to “public” so the judges can see your Post.
Limit one (1) entry per person/Instagram account for each Brand’s Grand Prize drawing for a maximum total of three entries, regardless of number of Posts. Any attempt to enter any Grand Prize drawing more than once via multiple names, email addresses, Instagram accounts, or any other means, may result in disqualification from this and any other promotional offerings from Sponsor. Use of any macro, bot, script, or other automated means to submit entries is prohibited. Proof of posting is not proof of accessibility of the posting to Sponsor or anyone else. Sponsor’s database computer is the official time-keeping device for the Sweepstakes. Entries will not be acknowledged or returned. In the event of a dispute over the identity of an entrant, entry will be depemed submitted by the authorized account holder of the email address associated with the Instagram account used to post the entry. “Authorized account holder” is defined as the natural person who is assigned to an email address or other similar account associated with the relevant Instagram account. No sharing of Instagram accounts, email addresses, or Post content is allowed.
ENTRY REQUIREMENTS: Additionally, all Posts must: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image; (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy, or publicity; (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans other than the Sponsor’s; (e) not depict any conduct or content that is unsafe, immoral, obscene, or otherwise inappropriate as determined by Sponsor in its sole and absolute discretion; (f) not have been submitted in any other Sweepstakes or won any prize; and (g) comply with all applicable Instagram policies and guidelines.
Each entrant represents and warrants that he/she has obtained permission from any and all recognizable persons other than the entrant depicted or mentioned in a Post and agrees, upon request, to furnish written proof of such permission. Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification. Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules.
PUBLICITY/USAGE RIGHTS: By entering, you warrant and represent that your Post (including any photo or video) has been created by you as an original work and that all required third-party releases (if any) have been obtained in writing, and you further acknowledge and agree that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast, and otherwise use your submission in any way and in any medium, whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online on Sponsor’s social media pages. Sponsor reserves the right to remove or reject any content it deems inappropriate for any reason. Except where prohibited, participation in the Sweepstakes and/or receipt or use of any prize further constitutes the winners’ consent for use of their name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).
WINNER SELECTION AND NOTIFICATION: There will be three (3) separate Grand Prize drawings, each occurring on or about 10/21/22, each for one (1) prize, plus one (1) Runner-Up Prize drawing for five (5) additional prizes, as detailed below. Limit one prize per person, regardless of the number of drawings entered.
Grand Prize Drawings: One winner in each Grand Prize drawing will be selected at random from among all eligible entries received for that drawing.
Runner-Up Prize Drawing: One Runner-Up Prize drawing will be held to select a total of five Runner-Up Prize winners, selected at random from among all eligible non-winning entries in the Grand Prize drawings.
Each potential winner will be notified via direct message on Instagram to the account used to enter within approximately 48 hours after the drawing date. No liability is assumed for any winner notification that is lost, intercepted, or not received by a potential winner for any reason. If a potential winner does not respond to any winner notification within 7 days, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected. Judges’ decisions are final and binding in all matters relating to this Sweepstakes. Each potential winner may be required to execute a Declaration of Eligibility, a Liability Release, and a Publicity Release (where legal) (“Prize Claim Documents”). If a potential winner fails to comply with Sponsor’s requests for Prize Claim Documents, is found to be ineligible, or cannot or does not comply with these Official Rules, he/she may be disqualified and the prize may be awarded to an alternate winner.
PRIZES/ODDS: Grand Prize: three (3) available, one (1) per Grand Prize drawing: a $1,000 American Express Gift Card. Runner-Up Prize: five (5) available: a $200 American Express or VISA Gift Card, plus a bundle of Dickinson products, selected in Sponsor’s discretion, with approximate value of $150.
American Express, VISA and Instagram are not sponsors of or in any way affiliated with this Sweepstakes. Prizes are non-transferable, and no cash alternatives or prize substitutions will be allowed, except in Sponsor’s discretion. A substitute of comparable or greater value may be awarded if the prize listed becomes unavailable for any reason. Each Winner is responsible for all federal, state, and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize. Gift cards may be subject to other terms and conditions.
Odds: The odds of winning in any drawing depend on the number of eligible entries received for that drawing.
ADDITIONAL RULES: Entry materials/data that have been tampered with or altered are void. No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, incomplete, or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission; (iii) theft, destruction, or unauthorized access to or alterations of entry materials; (iv) technical, network, telephone equipment, electronic, mobile device, computer, hardware, or software malfunctions of any kind; (v) inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (vi) any injury or damage to entrant’s or any other person’s computer or mobile device related to or resulting from participating in the Sweepstakes.
By entering, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the judges, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes that it sponsors any person who Sponsor believes has intentionally violated these Official Rules; and (ii) suspend, modify, or terminate the Sweepstakes if Sponsor believes, in its sole discretion, that malfunction, error, disruption, or damage is impairing or will impair the administration, security, fairness, integrity, or proper conduct of the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
PRELEASE OF LIABILITY: By entering, you (and if you are a minor, your parent or legal guardian) release Sponsor and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Sweepstakes from and against any and all injury, loss, or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use, and/or misuse of any prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize, except as expressly provided in these Official Rules. By participating, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Rules and all disputes shall be governed by the internal laws of the state of Connecticut, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the state of Connecticut, and you expressly consent to the jurisdiction of said courts and waive any objection thereto. For New Jersey residents: Nothing herein prohibits recovery of damages or attorney’s fees where required by statute.

WINNER LIST: For the name of the winners, available approximately two weeks after the end of the Sweepstakes Period, send a self-addressed stamped envelope to National Witch Hazel Day Sweepstakes, Dickinson Brands Inc., 31 East High St., East Hampton, CT 06424. Requests must be received by 12/31/22.
